Terms of Service
Please read these terms carefully. By creating an account or using GraphX, you agree to them.

1. Agreement
These Terms of Service ("Terms") form a binding agreement between you and GraphX ("GraphX", "we", "us", or "our") and govern your access to and use of the GraphX website, applications, APIs, and related services (collectively, the "Service"). If you do not agree to these Terms, do not use the Service.
2. Eligibility and accounts
- You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
- You are responsible for the accuracy of registration information and for keeping your credentials secure. You are responsible for all activity that occurs under your account.
- You may not share your account, resell access, or use the Service on behalf of a third party without authorization.
3. Subscriptions, trials, and billing
- New accounts may receive a 14-day trial. Trial features and limits may change at any time.
- Paid plans renew automatically at the then-current price for the selected billing interval until canceled. You authorize us and our payment processor to charge your payment method on each renewal.
- You can cancel a subscription from your account billing area. Cancellation stops future renewals and takes effect at the end of the current billing period.
- Except where required by law, fees are non-refundable and partial-period refunds are not provided. Taxes may apply.
- We may change pricing or plan features with notice. Continued use after a change constitutes acceptance.
4. Acceptable use
You agree not to:
- Upload, process, or distribute content you do not own or have authorization to use.
- Use the Service to infringe intellectual property rights, including reproducing trademarks, logos, characters, or brand assets without permission. See our Copyright Notice.
- Use the Service for unlawful, deceptive, fraudulent, or harmful purposes.
- Attempt to reverse engineer, scrape, overload, probe, or interfere with the Service, its security, or other users.
- Train machine learning models on Service outputs in violation of these Terms or applicable law.
We may suspend or terminate accounts that violate these Terms or that present risk to the Service or other users.
5. Your content
- You retain ownership of the images and other content you upload ("Your Content").
- You grant GraphX a limited, worldwide, royalty-free license to host, transmit, process, and display Your Content solely to operate, maintain, secure, and improve the Service for you.
- You represent and warrant that you have all rights necessary to upload Your Content and to grant the license above, and that Your Content does not violate any law or third-party right.
6. GraphX intellectual property
The Service, including its software, designs, branding, and documentation, is owned by GraphX or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted by implication.
7. Communications and marketing emails
By creating an account, you agree that we may send you transactional emails (such as receipts, security alerts, and product updates) and marketing emails, including newsletters, promotions, product announcements, tips, and offers. You can unsubscribe from marketing emails at any time using the unsubscribe link in those messages or by contacting us. Transactional emails are required to provide the Service. 8. Third-party services
The Service relies on third-party providers (for example authentication, hosting, storage, analytics, email delivery, and payment processing). Your use of those features is also subject to the providers' terms. We are not responsible for third-party services or content.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, secure, or error-free. You are solely responsible for your production output and for verifying it is suitable for your intended use.
10. Limitation of liability
To the maximum extent permitted by law, GraphX and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or production output. Our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amounts you paid to GraphX for the Service in the 3 months preceding the event giving rise to the claim, or (b) USD $50.
11. Indemnification
You agree to defend, indemnify, and hold harmless GraphX from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service at any time and may delete your account from your account settings. We may suspend or terminate your access at any time for any reason, including suspected violation of these Terms. Upon termination, your right to use the Service ends, and provisions that by their nature should survive will survive.
13. Changes to the Service or Terms
We may update the Service or these Terms from time to time. If we make material changes, we will provide notice (for example, by email or in-app notice). Continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which GraphX is established, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the competent courts of that jurisdiction, except where mandatory law provides otherwise.
